Welcome to Potato.cam. These Terms of Service (“Terms”) govern your access to and use of the Potato.cam website, app, and related services (collectively, the “Services”).

By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian.

2. Patreon-Linked Access

Some or all features of Potato.cam may require an active Patreon connection or an eligible Patreon membership.

By connecting your Patreon account, you authorize Potato.cam to:

  • authenticate your Patreon account

  • review account or membership information necessary to determine eligibility

  • grant, limit, or revoke access based on Patreon membership status, tier, or related criteria

Access to certain features may change if:

  • your Patreon membership changes

  • your tier changes

  • your membership ends

  • you disconnect Patreon

  • Patreon’s systems, API, or permissions change

We are not responsible for outages, errors, delays, or changes caused by Patreon or its platform.

3. Accounts and Access

If the Services allow or require an account, you are responsible for:

  • providing accurate information

  • safeguarding your credentials

  • all activity under your account

You may not share access in a way that circumvents membership restrictions or feature gating.

4. Acceptable Use

You agree not to:

  • use the Services unlawfully

  • interfere with or disrupt the Services

  • bypass or attempt to bypass access controls or membership verification

  • scrape, reverse engineer, or exploit non-public parts of the Services except where prohibited by law from restricting such activity

  • use the Services to infringe intellectual property or other rights

  • impersonate another person or misrepresent your affiliation

  • upload malicious code or harmful content

5. Membership Access and Availability

Potato.cam may offer features, content, or benefits that depend on external membership verification through Patreon. We may modify, suspend, or discontinue any feature, access rule, or eligibility requirement at any time.

We do not guarantee uninterrupted access, ongoing availability of any specific feature, or continued compatibility with Patreon.

6. User Content

If you submit or upload content through the Services, you retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as needed for display or operation, and use that content solely to provide and improve the Services.

You represent that you have all rights necessary for any content you submit.

7. Intellectual Property

The Services, including their design, branding, software, text, graphics, logos, and functionality, are owned by Potato.cam or its licensors and protected by intellectual property law.

You may not copy, modify, distribute, sell, or exploit the Services except as expressly allowed by these Terms.

8. Privacy

Your use of the Services is also governed by our Privacy Policy.

9. Third-Party Services

The Services may depend on or interact with third-party services, including Patreon. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services or their availability.

Patreon specifically offers OAuth-based member authentication for creator sites, but your use of Patreon remains subject to Patreon’s own rules and systems.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, accurate, reliable, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTATO.CAM AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF POTATO.CAM FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • the amount you paid us, if any, in the 12 months before the claim, or

  • US $100

12. Indemnification

You agree to defend, indemnify, and hold harmless Potato.cam and its affiliates, owners, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and expenses arising from:

  • your use of the Services

  • your content

  • your violation of these Terms

  • your violation of any law or third-party rights

13. Termination

We may suspend or terminate access to the Services at any time if we believe you violated these Terms or if suspension or termination is reasonably necessary to protect the Services, users, or our interests.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law rules.

15. Disputes

Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Rutherford county, Tennessee, and you consent to their jurisdiction and venue.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date. Continued use of the Services after updated Terms take effect means you accept the revised Terms.
