Welcome to Potato.cam. These Terms of Service (“Terms”) govern your access to and use of the Potato.cam website, app, and related services (collectively, the “Services”).

By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian.

2. Patreon-Linked Access

Some or all features of Potato.cam may require an active Patreon connection or an eligible Patreon membership.

By connecting your Patreon account, you authorize Potato.cam to:

  • authenticate your Patreon account

  • review account or membership information necessary to determine eligibility

  • grant, limit, or revoke access based on Patreon membership status, tier, or related criteria

Access to certain features may change if:

  • your Patreon membership changes

  • your tier changes

  • your membership ends

  • you disconnect Patreon

  • Patreon’s systems, API, or permissions change

We are not responsible for outages, errors, delays, or changes caused by Patreon or its platform.

3. Accounts and Access

If the Services allow or require an account, you are responsible for:

  • providing accurate information

  • safeguarding your credentials

  • all activity under your account

You may not share access in a way that circumvents membership restrictions or feature gating.

4. Acceptable Use

You agree not to:

  • use the Services unlawfully

  • interfere with or disrupt the Services

  • bypass or attempt to bypass access controls or membership verification

  • scrape, reverse engineer, or exploit non-public parts of the Services except where prohibited by law from restricting such activity

  • use the Services to infringe intellectual property or other rights

  • impersonate another person or misrepresent your affiliation

  • upload malicious code or harmful content

5. Membership Access and Availability

Potato.cam may offer features, content, or benefits that depend on external membership verification through Patreon. We may modify, suspend, or discontinue any feature, access rule, or eligibility requirement at any time.

We do not guarantee uninterrupted access, ongoing availability of any specific feature, or continued compatibility with Patreon.

6. User Content

If you submit or upload content through the Services, you retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as needed for display or operation, and use that content solely to provide and improve the Services.

You represent that you have all rights necessary for any content you submit.

7. Intellectual Property

7.1 Ownership

The Services, and all characters, lenses, filters, artwork, names, and related creative works made available through the Services (collectively, the "Licensed Content"), including the "Potato" character, are owned by [LICENSOR — see note below] and protected by copyright, trademark, and other intellectual property laws. Certain of this material is covered by U.S. Copyright Registration No. PA0002292014. All rights not expressly granted are reserved.

7.2 Limited License

Subject to your continued compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and fully revocable license to access and use the Licensed Content solely for personal, non-commercial purposes through the Services. This license transfers no ownership and exists only for as long as we permit.

7.3 Restrictions

You may not, without our prior written permission: extract, decompile, unpack, or reverse engineer any lens or .lns file or its underlying assets; copy, re-host, redistribute, sell, or sublicense the Licensed Content, or make it available on any third-party platform or repository; use the Licensed Content in any monetized, sponsored, branded, or commercial context, including a monetized streaming channel, without a separate written license; create derivative works except as expressly permitted; or remove any attribution or watermark.

7.4 Commercial and Ongoing Use

Regular, recurring, or monetized use of the Licensed Content — including use as a recurring feature of a streaming channel, brand, or product — requires a separate license. We may, at our discretion, extend permission for certain recurring use to active supporters at qualifying membership tiers; any such permission is a revocable courtesy, not a transfer of rights.

7.5 Revocation

We may revoke this license, in whole or in part, at any time, for any reason, at our sole discretion. Upon revocation you must immediately cease all use of the Licensed Content and delete any copies in your possession or control.

8. Privacy

Your use of the Services is also governed by our Privacy Policy.

9. Third-Party Services

The Services may depend on or interact with third-party services, including Patreon. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services or their availability.

Patreon specifically offers OAuth-based member authentication for creator sites, but your use of Patreon remains subject to Patreon’s own rules and systems.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, accurate, reliable, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTATO.CAM AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF POTATO.CAM FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • the amount you paid us, if any, in the 12 months before the claim, or

  • US $100

12. Indemnification

You agree to defend, indemnify, and hold harmless Potato.cam and its affiliates, owners, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and expenses arising from:

  • your use of the Services

  • your content

  • your violation of these Terms

  • your violation of any law or third-party rights

13. Termination

We may suspend, restrict, or terminate your access to the Services, and/or revoke any license granted under these Terms, at any time and at our sole discretion, with or without notice — including if we believe you have violated these Terms, misused the Licensed Content, or where we determine such action is necessary to protect the Services, other users, our intellectual property, or our interests. Termination does not limit any other remedy available to us, including under copyright, trademark, or other law. Sections 6, 7, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law rules.

15. Disputes

Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Rutherford county, Tennessee, and you consent to their jurisdiction and venue.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date. Continued use of the Services after updated Terms take effect means you accept the revised Terms.
